HAP tenant - issued termination of tenancy June 2023, tenancy to end 16 Dec 2023. Agreed to discuss tenant in situ scheme and applied for FCC to purchase the property.
Property was sale agreed with FCC 16 Dec 2023. FCC today pulled from the sale due to a covenant in the lease of the management company prohibiting the sale to a local authority.
Due to personal reasons and ill health we need to sell. I will get advice from RTB. Do I have to give notice again to tenant again for a further 6/7 months?
Can I put pressure on FCC to house the tenant as they have walked away, covenant is there but not legally enforceable but I am not willing to pay to fight it. Property will sell in open market quickly.
