The Cabinet has approved the draft legislation including long promised reforms that will allow Trade Unions to represent members even where employers refuse to recognise them for collective bargaining purposes.
The legislation means that in instances where employers do not recognise collective bargaining workers will be able to lodge claims based around pay , terms & conditions via their Trade Union .
Such claim will be adjudicated upon by the Labour Court based on comparisons with similar companies.
If the employer refuses to engage then the Labour Court determination may be enforced by the Circuit Court.
Legislation is also to be published to provide for Registered Employment Agreements once again .
The legislation also makes provision to prevent workers from being victimised by employers , such workers will be able to apply for direct relief from the courts if they can make a case that they are indeed being victimised.
This , although not delivering everything , is a huge step forward for Trade Unions , members & putative members .
