Can I get my deposit back?

I sold up my house in clondalkin in June and bought a small retirement house in Offaly. I viewed the house in April and the developer promised a completion date end of June, early July. I sold my house and gave the buyers a takeover date 31st July to give me time to move. I signed the contracts with the developer and handed over €20k as deposit. Its now mid December and the house is still incomplete and I've ended up renting. The developer says the problem is with the ESB and he cannot continue work until the developement has an electricity supply. I rang ESB networks and got the MPRN number - they inform me that the haven't got the wiring certs yet. I absolultely P****d off. The builder just keep saying to ring back next week. It looks like sometime in 2007 before I move in now. Can anyone tell me is there anyway I can pull out without loosing my deposit.

What does your solicitor say? What do the contracts say? Were the signed contracts returned to your solicitor?

In general, I would have siad 'no', but it depends on the contract.
