We were due to close on a new house before Christmas but due to pipe bursting and place flooding we were not able to. There was quite a lot of water damage and the builder is refusing to rectify a few of the items on our engineers report. Yesterday we were told that the builder is going to pull the sale of the house to us as we won't compromise. What happens in this instance? We have put about €2,000 into the house already tiles, shower doors etc. Also there are the valuation costs and snag report costs are we entitled to recoup those from the builder? And what happens with the 10% deposit we paid? Do we get this back and can we use it for another house?

I would think that both you and the builder have signed contracts. If this is so then the builder is obliged by law to deliver the house agreed intact and to spec. He can not pull out at this stage and if he tries then you sue for Specific Performance of the contract.

Did you have house insurance inplace? Once you start "adding" to the house you should have taken out house insurance to cover contents etc

Yes we do have house insurance in place but how would this make a difference? Surely we could not claim from the insurance company for the contents, I thought it would be the builder who would have to compensate us?
