can anyone advise me on this topic please. my partner is currently living in co cork and he recently divorced his mad wife. she has moved out of the family home and is renting a room off her new b/friend. My partner has offered her half of the equity on the house (done legally) and her solicitors have consistently ignored my partners solicitors letters!!! he is paying for the upkeep on the house and also paying the full amount on the mortgage. shes not paying a cent (which is typical of her).
can anyone advise what he can do as she still has a key and regularly tells him " this is half my house too".. can she come and go out of the house as she pleases...??? is there anyway he can legally push her to agree to a settlement rather than keep it hanging in the air?

"he recently divorced his mad wife."

Why was house not sorted in the divorce process?

If it was not sorted for whatever reason, then it does not sound as if negotiation can resolve this and perhaps he needs to go back to Court.

Surely if they had a legal divorce then the house was divided or they came to some agreement on it - If not why not?. There are two sides to every story, maybe she would describe your partner as 'mad' so try not to get into name calling.

They divorced through english law. The house/assets are entirly different (apparently)! The ex wife said she was happy to leave the house as he had built it himself and she didnt have interest in taking it over. the main problem being shes happy to be gone but wont part with the house! Its a rough situation. Does anyone know who would specialise in this area? Or where to even begin...
(also apologies for calling her "mad"). first time posting in here, great site. very useful.

Then the divorce was handled very badly - and before anyone says bloody solicitors, its likely either that this was a d.i.y. divorce or one where the lawyers were not properly briefed. The Irish assets may not be subject to UK jurisdiction but it would be the norm in any divorce in any jurisdiction to seek to negotiate a settlement dealing with all assets worldwide.

Now if Divorce was contested, then its possible that the UK Courts could not rule but then why on earth get a UK Divorce - unless there are substantial UK assets.

So, lots of issues- only OP's partner knows enough to deal with them. Suggest a speedy visit to a good Family Law solicitor in Cork - Rosemary Horgan in Ronan Daly Jermyn is top notch - and no doubt expensive.

MF - thanks for advise. ill be sure to pass on solicitor details to my partner. My partner and ex wife are english and married under english law so they had to divorce under english law. now, apparentely even though the assets take time to resolve etc the divorce can still go ahead (16 weeks in uk). It frustrating to watch this going on though... going to get him to call Ronan Daly Jermyn. cheers all for advise and replies. much appreciated
