When does a one off house establish its legal existence?

basically transfer of lands to builder a year or two ago, still no word from land registry.

Then house built.

Due to marriage both site and house may going into joint names, but where or how does the house exist legally?? All that exists so far is a land transfer.

I guess there must be new "deeds" drawn up for the house that the bank get their grubby hands on.

Anyone clarify this a bit more formally??
 
Legally you and your husband became the beneficial owners of the site once the deed of transfer was signed. However you will not become the REGISTERED owners until the registration is complete in the land registry. On completion of registration the land registry may issue a land certificate ( which is the original deed to the property) to your solicitor and they in turn will check the registration was done correctly and forward it to the bank. I say 'may issue a land certificate' because it is not compulsory to do so. As things stand now with the registration pending, there is nothing to stop you transferring or selling the property.
