Does the estate agent take their commission from a buyers deposit or after the sale is closed. If the former and sale falls through would the vendor be out of pocket.
 
Estate agent fees are normally payable on completion of the sale. The deposit is refundable so it wouldn't make sense to dip into that for fees anyway. If this is not just an academic question then ask your EA what their procedure is for collecting their remuneration.
 
On two sales I have done the EA took their fees from the buyers deposit once the sale is completed. The balance was transferred to the solicitor who then transferred sale proceeds less costs

Yep, same here. EAs generally insist on their outlays for advertising and photographs be paid up front. The % commission is only payable on close of the sale.
