Using similar domain name

Hi

The domain name i want to use has been taken but they have no currently active website,instead the person has just registered the domain name and put it up for sale on ebay:rolleyes:,this is very annoying as its the name i wanted to use,is this unusual?
 
Well that's unusual, I thought ie domains were more strict.
If you have a valid use for the domain that someone else is squatting on, maybe try contacting the IEDR.
As far as I'm aware, you never actually own an ie domain, just rent it. (This could be bunkum though)
 
If it was anything other than a .ie, I would have said the other person was squatting.

.ie domains are usually quite carefully allocated and they don't encourage squatters. You have to prove you've got a company, business name or trade mark (registered to you) or some other strong claim on a given domain, such as a family name.

One option, if the other person is not really using the domain is to ask the .ie registrar to allocate it to you on the basis that you've got a strong moral claim and will use the domain as it should be.

On the other hand if you register a similar domain, you're leaving yourself open to trade-mark infringment claims if the other domain has a strong enough case.

It works two ways, maybe you need to think of something different.
 
The IEDR will do nothing. You have to refer all disputes to WIPO which costs about $1500 per dispute.
 
They are registered as a sole trader under a different business name.Sent email to IEDR.I will see if i can contact the seller too.
 
As I said earlier the IEDR do nothing and will wash their hands of the matter, and refer you to WIPO with you having to pay the costs of arbitration. The seller will most likely blank you knowing that if you really want the name you will either pay their ransom or pay WIPO to get it back. At a guess the ransom will be $100 less than the WIPO costs.

The IEDR are covered as they saw a RBN cert and issued the domain in good faith.
 
Well i won't be paying anything near 1500,i don't need the name THAT badly,im sure i can think of something else its just i was kinda set on using it.
 
is this for an existing venture or one you are just setting up?

The IEDR does not allow people to put IE domains for sale on ebay or elsewhere due to the registration rules.
 
No problem selling a domain so. Standards at the IEDR have slipped in recent years.

If you advertise an IE domain for sale and they find out they will pull the registration or threaten to do so. I've seen it happen.

Personally I wouldn't mind there being a proper aftermarket in IE domains, but the current rules don't really allow it, as you still have to prove your entitlement to a name.
