Up to what point is deposit refundable?

I've found any information I have on this to be quite ambigous. Would appreciate clarifaction from someone.

I put down a €5000 booking deposit on a property approximately 4-5 weeks ago. The contracts are now ready to be signed, but I have put it off signing for a few days while I get a few questions answered. My booking deposit cheque has already been cashed. If I pull out now, am I guaranteed to get my booking deposit back, and how will I get it back - do I have to wait for the developer to write me a cheque?

Thanks. That's what I thought, but was beginning to doubt myself. Anyone know how the procedure works when getting your deposit cheque back after its already been cashed?
