TUPE and reassigning roles in the Company

my company has decided to outsource part of it's IT department to another company who specialise in IT outsourcing.

1helpdesk services - 7 people
2setting up project sites -3 people
3Auditing of equipment - 3 people
4equipment repair - the same 7 people as on 1.

are all being transferred (excludes me) so all those people under TUPE are told they will be transferred to a similar position, and if they don't like it they can resign.

in financially tight times these things happen, but I think they are moving across the boundry as to what they are legally allowed to do.
our networking team (2-3 of us up to our eyeballs in work) are now being told we will be taking responsiblity for up to about half of 1, the helpdesk have a lot of specialised areas which they don't seem to be transferring (so about 3 full time positions), today I am being told we are also doing 2 from now on (another 3 full time positions) and 3 is going to some developers/ project management.

So I am trying to work out what is actually being transferred, and why 13 people have been transferred and their daily tasks are being reassigned to employess not being transferred despite announcing all their roles are being transferred?

Is this legal?
