Top Slicing...problems claiming on ROS

I received redundancy last year. I wrote to revenue to claim top slicing relief (TSR) but they wrote back to tell me to claim the TSR in my income tax return ( I had used ROS in the past because I had sold some share options). However, when I look at Form 11 on ROS all I see is the vague statement "Amount of TSR claimed in 2010". But I haven't claimed anything yet?? Do I do the calculations myself? Form 12 looks to be more suitable but there is no electronic version of Form 12 on ROS (well, I don't see the option in ROS for me). Any thoughts? Thanks.

Fill form 11 in as much as possible. Bring it into your local revenue office and ask them to help you go through it. You'll be pleasantly surprised at how helpful and detailed they'll be in helping you get the most back.

I did this for my Dad last year, they were brilliant

This approach is fine when there is nothing too contentious in relation to a tax return but I wonder is it an advisable course of action is an individual is making a potentially large claim for Top Slicing Relief, which could easily run into five figures? Revenue have no duty of care whatsoever towards an individual in ensuring that their tax relief claims are maximised. The individual has no comeback whatsoever if they later find out that an error was made, and additional tax refunds are restricted by the four year rule.

Hi,

If I am reading your OP correctly, you were only a chargeable person (ie a person required to file a Form 11) by virtue of your share options. If that is the case and these were not an issue in 2010, then Form 12 is the correct form for you.

However as you are already aware, you can't do a Form 12 on ROS, you'll need to do it the old fashioned way.

Bearing in mind what Tommy said above, if you are happy that yours is a straightforward case then Revenue generally are very helpful and diligent in these cases.

Thanks for the replies. TMcGiblney.....just so I'm clear: if I put in my own calculations for TSR into Form 11 online who checks this?

To close off this thread: I rang revenue. They concurred that I need to add in my own calculation for Top Slicing Relief into Form 11 on ROS. Once I submitted Form 11 it would be checked at a later date. However, they advised me it would be best to email in my calulations to them before sumbitting so I was sure I was in the right ballpark. They told me not to bother calling in as they wouldn't be able to verify the numbers there and then; email was better.

Thanks to all the AAM posters for pointing me in the right direction.
