AIB The Appeals Panel is clearly not even bothering to read the appeals

I received no 3rd response from AIB. I have however received the decision of the tracker panel today which is the standard unsuccessful decision they seem to be issuing to all.

They don't even mention the arguments put forward in my additional submissions regarding definition of prevailing rate etc and challenging AIBs misrepresentation of my argument. They appear to have just ignored this. The following paragraph in particular annoys me:-

'The Panel was satisfied that, had the Bank offered a tracker mortgage at this time, it was contractually entitled to offer the then prevailing interest rate at the end of the fixed rate period. The Panel was satisfied that the Bank did not have an obligation to offer any element of the rates prevailing when the mortgage was first entered into'

The only conclusion one could draw from this paragraph is either that they haven't read the appeal, or if they have read it they've chosen to completely ignore the argument contained in the appeal. Either case tells you all you need to know about the appeals panel, draw your own conclusions.

Would you mind posting the full decision.

That is an odd line. Had you suggested that you should be given the rate prevailing when the mortgage was entered into?

That line has not been in any of the appeals decisions I have seen.

Hi Brendan

No, I never asked for the rate at the time I entered into the mortgage. The opposite in fact, I stated several times I was looking for the prevailing rate existing at the end of the fixed rate period and argued the case that a prevailing rate existed. Will post the full decision, I just need to redact the names.

I had not noticed that before. So the response you got is exactly the same as the second standard response people are getting.

Agreed. They are clearly not reading the appeals and just issuing the standard response.

It is also possible that they are reading them but that they do not have the expertise to understand mortgages. This particular paragraph illustrates to me that they do not understand the concept of a fixed margin.

Could be that they don't understand mortgages which if that is the case would make the Panel literally ridiculous and deserving of zero credibility.

It could be also that they are snowed under with appeals so are categorising them and issuing the standard response for the particular category.

Who knows? either way its a waste of space :)
