I received no 3rd response from AIB. I have however received the decision of the tracker panel today which is the standard unsuccessful decision they seem to be issuing to all.
They don't even mention the arguments put forward in my additional submissions regarding definition of prevailing rate etc and challenging AIBs misrepresentation of my argument. They appear to have just ignored this. The following paragraph in particular annoys me:-
'The Panel was satisfied that, had the Bank offered a tracker mortgage at this time, it was contractually entitled to offer the then prevailing interest rate at the end of the fixed rate period. The Panel was satisfied that the Bank did not have an obligation to offer any element of the rates prevailing when the mortgage was first entered into'
The only conclusion one could draw from this paragraph is either that they haven't read the appeal, or if they have read it they've chosen to completely ignore the argument contained in the appeal. Either case tells you all you need to know about the appeals panel, draw your own conclusions.
