termination of letting agreement questions please.

This post is on behalf of a friend.

My friend is letting a house out to a family and 5 months in she decided that she wanted her house back. A combination of factors including that the tenant was quite demanding but she has also decided to move back in.

In the letting agreement which both parties signed it states that both parties only need to give one months notice. My friend offered two months notice and said that if the tenant wanted to move out any time that she would get a refund of any money overpaid. There are plenty of houses available in the area so the tenant would have no problem getting another house...

Today my friend went to collect the last months rent and the tenant told my friend that she had been in contact with a solicitor and that she was seeking compensation and that she was going to bring her to court. She refued to pay the last months rent but said that she would use up her deposit for the last month.

My friend phoned me in a bit of a state..

I advised her to get in contact with a solicitor but has anyone got any pointers. Does the tenant have a case? Can she sue for compensation? Did the Landlord act outside of the law?

Any advise would be appreciated.

Perhaps you could elaborate for the benefit of future posters who may have the same problem?
