Tax refunds after accident

Hi,

Hopefully someone can help me out here with some basic addittional questions on this same topic. My employer paid me my base Salary until end of June, 75% of base in July and August and 50% of base in September where they will cease to pay anymore and their insurance company will assess my claim.

Can someone clarify the following please;

  • Shouldn't I be entitled to a refund of my tax credit allowance for September since I'll only be receiving 50% of my base pay (due at the end of September)??
  • Since my employers last payment to me will be at the end of September, if the insurance claim is accepted, should I get to keep the illness benefit (I've been paying it to my employer to date)?
  • If the insurance claim is upheld, will that payment be taxable or will I be entitled to a refund of my remaining tax credits for 2009?

I've moved this post from another thread as it relates to this forum mainly, and should get more replies here. To answer the second point you make, your Illness Benefit cheque is paid personally to you and your employer has no right to recieve it. what happens in practice is as you state, the recipient hands it over to employer when employer is paying more than IB. When the employer stops paying youi, then you hold onto the IB cheque.

Thanks Welfarerite... that answer for the second point is much appreciated. However, in addittion to my other questions, I have some other questions, namely;

  1. When the insurance policy begins to kick in in October and hopefully begins paying me, will I still have to pay over the illness benefit to my employer?
  2. I realise that illness benefit is taxable but I think the pay that work is providing me with is taxed based on me receiving illness benefit... suppose there's not a lot I can do here since work have no legal obligation to pay me.. or is there?
  3. I had 29 days holidays at the time of my accident... what happens to these days if I return to work after this financial year i.e. after December 31st... will I lose them?
 
If my questions are too specialised, then maybe I should contact an accountant, social welfare office and citizens advice bureau along with other specialist forums or sites to get as much helpful information as possible...
 
I had all my queries answered by the Citizens Advice Bureau although, predictably, they also advised me to contact the Revenue regarding my tax questions.

I also found out today that the RTU provide a source of payment for expenses incurred for the duration of the course so things are looking better I guess.

Welfarerite, quick question, like you said, when my employer stops paying me, I stop paying them. So I am now in the situation that the insurance claim has been upheld. I usually get paid monthly on the 27th. If the Insurance company initiates their payment in November for October (it pays monthly in arrears), when should I then terminate my illness benefit payments to my employer (since they also pay monthly in arrears)?
