Tax on rental income

Hello

I'm living abroad since mid-2009 and I have been leasing my Irish property. As a non-resident, am I liable to pay tax on this rental income to the irish govt?

Short answer is that you are liable to Irish income tax and should do an income tax Return and rental accounts.

The 20% witholding tax regime is supposed to be implemented by either the tenant or letting agent but rarely is in practice - but thats not your problem.

Find an accountant to deal with the submissions for you - can all be done by email if necessary.

Don't forget all the usual cavaets re. PRTB registrations etc
 
You can nominate what Revenue call a 'collection agent' in this jurisdiction which will mean you do not have to get that 20% deducted.

This is the easiest way as you cannot trust the tenant to pass on the deduction to Revenue.

It doesn't matter whether the tenant passes on the deduction to Revenue or not - that's really between the tenant and Revenue and you would in fact be far better off if Revenue grossed up the rent and assessed it on the tenant. An unscrupulous landlord could do well here - get tenant to pay his tax for him really.

The [broken link removed] has been giving out about this for some time - seems tenants who don't deduct can find themselves in a whole heap of trouble.

I think this is ridiculously unfair on the tenant in case anyone thinks I condone it.
