Tax on Irish income - after returning from Germany

I am wondering if anyone has heard of a situation like this one?


I am Irish, my wife is German and after many years in Ireland we moved to Germany for 8 months in May 2015


From Jan 2015 – May 2015 my wife was unemployed in Ireland; I had a part time job and earned 8K, with a net also of 8K


Then we went to Germany, I was unemployed there and my wife was a German “PAYE” worker.


Then we left and returned to Ireland Jan 2016.


Now my wife is doing a tax return for our time in Germany.


Now we THINK we shouldn’t owe anything, as she paid payroll taxes in Germany, and my Irish work was taxed under PAYE in Ireland (although nothing was actually due). Yes ,there is a mutual tax agreement with Germany


BUT if my income goes into our/her German tax return, would they say that all income is taxed in Germany (we were tax resident for the year), with merely a credit for Irish PAYE paid (which is zero), possible leaving me/us /her paying some German tax on my Irish income, despite the fact I never earned a penny while in Germany? Any thoughts?


To recap: We have paid tax on all German income in Germany, and all Irish income in Ireland; but it German tax rates are higher…can the German taxman ask for the difference, in relation to Irish income?
