If living in Australia and getting paid an Income Protection Benefit by my employer in Ireland. Is it possible to get an exclusion order from revenue to stop paying tax on this in Ireland and instead pay the tax in Australia. I will be a Permanent Resident in Australia
Any help appreciated

The exclusion order will cover all emoluments from your employment so if it covers your salary it will cover BIKs like this.

Thanks dublin66
Do i take it then that i should be able to get an exclusion order and pay tax in Australia as opposed to paying it in Ireland as I will be leaving ireland permanently but still getting payment from Ireland. I presume they need some sort of proof that i am paying tax in Australia on the income coming from the Income protection policy. Do i just contact the local tax office and discuss it with them
Many thanks

Have you checked if you can receive the payment if living in Australia.
Attached is extract from our company policy with Irish Life.

Residence and Travel - For the purposes of this Policy "Accepted Residences" shall mean Republic of Ireland and United Kingdom. The Employers shall give immediate notice to the Company of an Insured Person becoming ordinarily resident outside the Accepted Residences. The Employers shall only be entitled to the benefit of this Policy relating to an Insured Person while that Insured Person is ordinarily resident within the Accepted Residences and any Benefit relating to him shall not be payable for more than 13 weeks in any period of one year (subject to an overall limit of 39 weeks in total ) while an Insured Person is outside the Accepted Residences, unless the Company shall otherwise agree

In addition, how will you attend medical assessments ?

Thanks Joe
My policy states
"If the insured person, unless otherwise agreed by the company, is absent from the exempt areas stated in this clause for more than 13 weeks in any consecutive 12 calendar months the provisions of the policy in respect of that insured person shall be deemed to be terminated. the exempt areas are"....(list of countries including Australia)
so i presume i am ok in that respect.

I have not had any medical assessments since the acceptance of my claim my condition is incurable and permanent so i guess they have accepted that much

Still need to know if i can get an exclusion order?
