I was made redundant last year & I recieved a redundancy lump sump from my employer (Tax free).
One month after my redundancy I filed to take my employer to the EAT (unfair dismissal) because they had put someone into my former position.
In July of this year we settled out of court but my employer is saying that the settlement is to be taxed at 41% even though I have given them a current tax credit certificate.
Are they correct in taxing the settlement at the higher 41% rate ?
