Statutory Declaration Validity

Hello, we prepared the documents to give our tenant to vacate as we plan to sell (only because of all these restrictions and we are way under market value rent plus hopefully it's a good time to sell up). We got the Statutory Declaration signed by the solicitor on 24 March but just haven't got around to giving the notice until now, but we will do this weekend. I can't see any information as to the validity of this document. it will be just over 3 months since it was signed, is that still valid? Thanks.
 
Also, sorry I forgot to ask.....if you hand delivery the notice, do you have to have 2 copies of everything and get both them and you to sign to say it's received....am just thinking what if they said they never got the notice from you, what proof do you have? thanks
 
Why take the chance - redo the document.

Send by recorded delivery.

If the tenants have been inclined to act the maggot in the past, personally, I would also email and hand deliver.
 
I think everything has to be dated the same day - so eviction notice & statutory declaration dated the same day and posted/delivered to the tenant on the same day (make sure to have proof of postage/delivery). Then copies of everything have to be posted or emailed to the RTB on the same day including a special form which they have.

It might be better to just get a solicitor to handle everything.

They've set this up so that you will make a mistake and end up back to square one at the end of the notice period when the tenant tells you that the paperwork wasn't correct.
 
The tenant has to lodge any objection with the Rtb within ninety days. Does the RTB let the landlord know that there has been an objection, I wonder.
