Hi guys, my partner and I are looking to buy a house. I have an apartment that I purchased before we met. I was a first time buyer. We are hoping to sell the apt. My question is can we avail in any way of her first time buyer status in terms of not having to pay stamp duty on the next purchasei.e. two on the mortgage but just herself on the title. Is this legal? Secondly, if we get married does it affect our situation? Basically I am trying to find out if there is a way that we can avail of her first time buyer status in terms being exempt from that horrible tax on freedom of movement. Any help would be appreciated.
 
Sorry, no you will not qualify for first time buyer relief in any of the circumstances you outline above.

However, if you buy a newly constructed property with an area of less than 125 sq metres and you will live in it as your home, then it doesn't matter how many other houses you have purchased, you will not have to pay Stamp Duty.
