stamp duty for 2nd property

My partner currently owns a apartment with his brother (and has done for almost 3 years). This was a new property for which they paid €355,000 and no stamp duty.

We are now buying a apartment together, also new (€375,000). It is planned to keep 1st apartment and his brother will continue to live in it. I am a first time buyer.

Our solicitor has advised us that we are liable for stamp duty on either one of the properties as my partner cannot be a owner occupier in both (obviously). We had understood that once the 1st property is not rented out in its entirety, no stamp duty was payable.

Can someone please advice whether we should be paying stamp duty and if so on which property and for approx how much?

buy the new property jointly with a joint mortgage and only register the property in your name and get your boyfriend to sign a guarantee for you to tie him into the loop
