My husband who was self-employed could not get any building work after the recession first hit last year so he applied for jobseekers allowance July 2009. He filled out all the necessary forms and gave all the information they asked for (which seemed neverending) and he was paid by the community welfare office in October weekly and has been ever since. So his claim never fully went through yet even though he attended an interview last January with a social wefare inspector. He is obviously owed back-pay from July to October of 2009 and he went to a local politician to try get this claim sorted and he told us he would put it to the minister for social and family affairs who was mary hannifan but has since changed. This morning we have received a letter asking my husband for a p45 from a guy he worked for last year for 6 weeks. My husband was paid cash in hand for this work. On the letter they state he must have this p45 in to them within 7 days and if he doesnt then all payment will stop with immediate effect. We are gobsmacked and very worried now as we have an 8 year old boy and another child on the way in 3 months. We are meant to be getting rent allowance payments from this week also. Can anyone shed any light of what my husband should do now as we are at a loss and dont know how to proceed. Thank you.

Did your husband actually tell the SW that he did work for this guy ? It seems someone has given them this information and they're following it up. I'm afraid cash in hand is tax evasion so you will not get much sympathy here. Your husband needs to come clean with everyone i.e. SW and revenue. He would have had to give his P45 to the SW from day one so it a bit strange that they request this now unless someone has reported either him or the chap he worked for to the authorities. Regarding the payment you currently receive from the health board, these are different from the SW and should still be paid.
 
Are self-employed people issued P45s? I thought that this was limited to employees? Maybe someone can clarify this?

Lukesmom, I have limited knowledge about tax returns and job seekers allowance for self employed people but I think your husband may have to file his tax returns for last year early to claim for jobseekers allowance. I presume it might have been a low enough sum but he may still be liable for tax and PRSI.

Usually you have until October 31st to file tax returns for the pervious year so technically he has not evaded tax until then. This link might help some more :


I presume that he was paid for the cash job prior to claiming for jobseekers allowance?
