what do you mean by 'Capital Rules ... to get benefit'? do you mean the rules for assessing of capital for means? If so, the rules cannot be appealed, only the way that they have been applied by the Deciding Officer.

Under the Social Welfare Act of 2005 it states that your home should not be assessed. The law was made at a time when we think people were not doing as we are now, renting out their own home and renting somewhere bigger to live in.
I think you have a case. Basically, they seemt o be assessing your only houser as a 'second property'. So you are appealing their interpretation of the rules rather than the rules themselves.
