Septic tank - major problem

Just had a guy out to empty and survey our septic tank after only having it emptied in August.
He told us that the tank was a small one and the wall between the 2 chambers had been smashed by what he thinks was a sledge hammer. He reckons the tank was too small and broken through so it wouldn't need to be emptied as often. Of course this is having a problem with the percolation. He thinks that this was done when it was installed but can't be sure.
We bought the house 6 years ago and the house was built 9 years ago.
The question is do we have any come back from (a) the builder or (2) the previous owner.
The only was to rectify this is to get a new tank which of course i'm really peeved at.
 
Statute of limitations on breach of contract is 6 years. It sounds like you are too late - but if you want to seek redress, you should consult your solicitor immediately.

That said, the cost of legal action versus the cost of simply repairing the septic tank means that it is probably uneconomic to litigate - even if you had a cast iron case ( which, on the basis of the very limited info supplied, you don't)
