hi folks

wife and I had a small biz. I was owner and sole shareholder. Wife did day to day activities and was listed as a director. My wife has been put under s class rather than e class by accountant without asking us. Business closed and since then my wife was working 6 months for another company. She was made redundant and now cannot get benefit as she has a few years s class contributions.

Welfare state that this can't be changed and it looks like she won't get any money purely as a result of s class status. Any ideas what we can do?

It sounds like she cannot claim Jobseeker's benefit as she has insufficent Class A cons. in 2007, the governing year for claims made in 2009. Her only other option is Jobseeker's Allowance but this is means tested (including your income). see keypost in Unemployment and Redundancy forum.

paid full contributions - thats been confirmed. Apparently, the only reason is the 's class' contributions - and there seems to be no way to reverse that. Accountant isin't interested and social welfare says it can't be done anyhow and even if it could wouldn't make a difference anyhow (according to wife this is what was said-don't shoot me for mixed messages!)

It's standard practice that if you work for your spouse you cannot put on class A contributions.

Your accountant should however have put your spouse on class k contributions which would mean that she would have paid nil PRSI.

I'm in the same boat and go down as class K because the way I see it I will not get any thing from the state not even a pension.

Class S are not full contirbutions so why are you saying 'paid full contibutions'?

When in doubt as to which class of PRSI contact the Scope Section of the DSFA and they will decide. It appears yoiur accountant should have done this as Calss S is for self-employed
