Section 23 Underpayment

Hi,

I was wondering is anyone had any advice on the following. I have had my tax credits reduced to 0 without any contact from Revenue. When I rang them they informed me that an apartment I sold approx 10 years ago was still benefiting from Section 23 tax reductions. So the Section 23 tax credits continued way passed the 10 years it was supposed to and Revenue are saying that their system doesn't shut it off after 10 years, that it's up to me to let them know..... I stick my hand up and admit I forgot to tell them I had sold it, but they are now claiming I own them for 11 years of tax credits and they have started to take massive payments from my monthly salary.....At this rate of consumption by Revenue, I have approx. 2 months before my current house is repossessed. I have engaged a Tax accountant and a solicitor, but was just wondering is anyone had a similar experience with this "stand up" section of our society?

Regards,
Morgan

First thing I note is that there may be a statute of limitations issue. I know that in cases of (alleged) fraud or negligence there is no such limitation, but maybe this is something to discuss with your solicitor.

I know that none of our clients have ever had issues any further back than 4 years as is the norm.
