I got a modest sunroom at the back of my house built in the summer,13ft by 13ft.Prior to constructing the sunroom I obtained quotations from four separate building companies all of whom informed me that the construction of a sunroom consists of exempted development under the planning and development regulations,2001.I was also aware that under the said regulations it is permitted to construct a sunroom provided the floor area did not exceed 12sq meters.
Anyway to cut a long story short the day the builders were finishing the sunroom I got a visit from a planning officer from Fingal County Council. One of the neighbours had put in a complaint about the sunroom saying it was blocking light even though the sunroom was behind the boundary at the bottom of his garden.The planning officer said normally he wouldn't have a leg to stand on but it turned out that in my particular estate there was a condition put in which went as follows;
"No extensions to the dwellinghouse shall be erect nor additional windows installed at any part of the development herein without the prior written consent of the Planning Authority"
The Fingal planning officer said the reason this was put it was because some of the houses in the estate are small with very small gardens. He then went on to tell me that it was just a bit of red tape and because my garden was so long (63feet) that all I have to do is reply to the council when I get the notification and look for the consent to keep the sunroom and that I shouldn't need planning permission.I got my solicitor to do this and about four days later I got a letter from Fingal telling me I'll have to apply for permission to retain the sunroom.I think its very unfair considering my garden is 63feet by 20 feet in size and the sunroom is only 13 by 13 ft.
But anyway there's nothing I can do about it now only apply for retention planning permission.I was just wondering are there any companies in the Fingal area that specialise in this sort of thing or should I just go back to the company that built the sunroom?
