Rental Apartment - Leak From Upstairs

Hello all,

I own an apratment which I rent out.

The tenants have informed me that there was a leak from the upstairs apartment.

I have not yet seen it but per the tenants the ceiling in the en suite bathroom is damp, does not look too bad but might need repainting.

The tenants also informed me that the owner of the upstairs apartment has offered to paint the ceiling.

I would appreciate advice as to what I should do.

There is an insurance policy for the entire block. Should I make a claim against this policy?

Is it fair to expect the upstairs apartment to fix my damaged ceiling?

Excess on block insurance claims tends to be anywhere between €800-1500 so chances are it's not worth claiming.

You need to get the ceiling checked out, it could be more serious than just a paint job. The owners upstairs should be responsible for any costs incurred.

why are the people upstairs responsible? im not arguing with you ,im just interested. i mean surely only a 'flood of water' would come down not just enough to dampen a ceiling. am i making sense?
