Rent Tax Credit

Hi guys,

Saw a query on another board about the above.

The guy was "renting" a room in his house to his partner and she was claiming rent tax credit.

Romance is never dead and all that.

He also said "it would be my view that even a husband could charge his wife rent and she could get relief on this should she wish"

I've had a look at the legislation and while it specifically disallows a claim made by children on rent paid to parents I don't see reference to a partner.

What are others opinion in the entitlement to rent credit for rent paid on a partners house while both reside there. I think it's not allowed as contributions could not be considered rent in this situation.

Interesting topic.

There's a marked distinction between a married couple and unmarried cohabitants for starters - I would say a husband couldn't charge rent to his wife, given her rights under the Family Home Protection Act.

As for unmarried cohabitants, there might be a case there - I'll have to mull over that one for a wee while...
