Remortgage not given at tracker rate

Original mortgage with PTSB at tracker rate but when we remortgaged in August 2008 and asked for this at tracker rate we were told that they were not available, should we not have being entitled to the tracker rate, instead we were given variable 6.2 percent.

no. Why would you? They told you they werent available and you went with a different available option.

Or you could have seen what was available elsewhere in the market at that time.
