Reminder to pay tax that is paid. Non resident LL

So I am a Non resident LL.
I have 1 apartment rented out and get my tenants to pay the 20% tax from the rent monthly and they pay the tax at the end of the year. ( 2015 tax paid in full.)

I get a reminder to pay tax so ring the office dealing with Non residents in Dublin. They said I should submit the Form R185 (Certificate of Income Tax Deducted) with my form 11 before Sept 2016. They ask me to contact Limerick to say I am Non resident as that is where the reminder comes from.

I called they said they have no record of the payment I need to speak to Dublin office. Basically they have no way to add in their system that my tenants have paid. They wanted me to pay preliminary tax.

I am unhappy with the tax office as are my tenants who visited the tax office 3 times before finding someone who know what to do and take the tax.

I have emailed all the details last month to the tax collector general but without answer.

Anyone have some light to shine on this as tax is paid but tax office in limerick not happy.

Very trusting (/unbelievably naive) of you to expect your tenants to pay the tax at the end of the year - is this a scam thread?

Your tenants should be able to provide some proof to you that they paid the tax - if not, they're in breach of their tenancy agreement and should be dealt with accordingly etc etc.
 
Gar there is a difference between having to file a preliminary tax return and paying prelim tax.

The system generates a notice if you have not filed a return. File a nil return of you don't owe anything.

Having said that I'd be concerned that the tenants would not pay the tax over!!

Yes but before Sept with my form11.

My question is why when the tax is paid are the systems in Dublin & Limerick not connected to know that?
 
You're making your own life difficult by trying to think you can fix revenue systems. I'm non resident and I wouldn't dream of letting my tenants deduct 20% and pay it on my behalf. Just stop doing this, do your tax returns and pay any tax as required. Revenue have never asked me to do it the way you do it.

From your own link I've copied this important bit, it means that ultimately you are the liable person. If the tenants don't pay, you'll still be liable if tax is due.

1. The obligation to deduct tax on payment of rents does not

make the tenant a chargeable person (section 959A TCA

1997).
