Redundancy While Pregnant

I am looking for some advice please my wife has been made redundant and is on maternity leave until december, the company has went into administration but as some of the debt has been bought some staff are being kept on. She has been ther under 2 years so we are not entilted to reduancy payment according to the administarators,would her maternty pay be paid by social services and at the same rate? The administrators have been less than helpfull and we really dont know where we stand, any help would be great.

From the FAQ on the entemp website here it looks like she needs to call the Equality Authority:

"13. Can an employee be made redundant while on Maternity Leave or on Additional Maternity Leave?
No. Notice of Redundancy (included in RP50) cannot issue when a person is on Maternity Leave or indeed on Additional Maternity Leave. The Equality Authority are the experts on this and callers can be referred to them at (01) 4173333. (Lo Call – 1890 24 55 45)."
 
As your wife is already on Maternity Leave I assume she is in receipt of Maternity Benefit from SW. That should continue at the same rate as she is currnetly on for 26 weeks in total.

She would be deemed to be in employment while on Maternity leave.

Would that bring her up to 2 years with that employer

It would by end of December (when mat pay ends) she would be there well over 2 years
 
You said she was made redundant, did she get a P45. If not she is still employed but should have not got a P45 while on Mat leave as Purple has shown

If she is on maternity leave at the moment, and her maternity pay (from welfare?) ends in december, would that not mean that she is getting more than 26 weeks? Does her maternity pay end sooner and her additional, unpaid maternity leave take her up to December?

Her P45 will be sent in the post after she completes an RP1 form?

She is on maternity at the moment and it finishes at the start of December, in total it is 39 weeks the company will pay until 15th May (thursday) we will contact welfare on monday dont know if they pay the same rate as the company, thanks for the help folks

Why would she complete an RP50 now while on Maternity leave. By doing that is she now making herself redundant. I think that form should be completed at the end of her Maternity leave.

By the way time spent on Mat.leave and additional Mat leave are reckonable for Redundancy

There seems to be some confusion as to whether the company is paying her during Mat leave or whether she will have Social Welfare only. The SW rate is €221.80 minimum - €280.00 max. Hope she is getting this or why would need to go to SW
