Our employer issued an email to staff in late July advising that he was seeking voluntary reduncancies, as their business was experiencing
a downturn. I considered same with my spouse and in late August advised my employer re. my decision to leave. They advised that i should work my months notice - which i am completing this week.

They said they would check if i would get any redundancy payment and have now reverted to me advising that as they are recruiting additional staff, i will receive no such payment. I noted that they were seeking staff for another branch office office before the email re. redundancy. In addition, they have offered me contract work as such will arise if i am am available the future (i.e. 3/4 days per month) To date, one staff member has left and received a payment.

Can anyone advise how to approach this matter.

Hi

Thanks for interest- yes i wish to know if i am entitled to any payment re. 'redundancy'?

Were there any terms and conditions in the original email request for voluntary redundancies?

No terms- just that if they wanted some people to leave as times were bad! We already knew this from previous as we had all taken a pay reduction some weeks prior.

Normally, voluntary redundancy would be done as an agreed set of terms conditions, as you're being asked to give up employment terms and conditions. Typically you would expect some form of payment.

However, if you don't have such an agreement, all that's happened is the employer has asked for people to resign and some have obliged, in which case there's no payment due as none was agreed. People don't get paid for resigning.

So it all depends on what was agreed beforehand.
