Redundancy during Take Over

My company are being taken over by a much bigger operation.
All staff are encouraged to interview for positions they are qualified for.
I applied and interviewed for a position that I am qualified for but that would be deemed a promotion position. Unfortunately I was not successful.


Staff received an email from HR before some of these interviews took place and in it was stated that a staff member who entered the selection process and is not successful will be entitled to avail of the severence terms at that point.


I would now like to avail of the severence terms as I don't want to take my current position (due to the longer commute as company is relocating and I feel after reading the job spec that my current position has been down graded somewhat) but HR told me as the job I applied for wasn't my current position and that it is still there for the taking I wouldnt fall into the cateogory of "entered the selection process and was unsucessful and therefore am entitled to redundancy."

Does anyone know if I am within my rights to push for redundancy? I can't find an answer to this one anywhere!! Thanks
 
Do a search for the term "TUPE" (as in Transfer of Undertakings Protection of Employees) as you may find some useful stuff in existing threads.
 
Thanks ClubMan I shall research TUPE. I printed the booklet from entemp and will look back through old posts.
