Can anyone help with this.

My gran recently died and her house had just gone on the market a few days beforehand.

Does anyone know what the legal implications of this are - can the house stay on the market and be sold as normal or would it have to be transferred into the ownership of the beneficiaries of the will first? If so, how long would this take?

Any info would be appreciated.

thanks.

Sorry for your bereavement. The house can stay on the market, and the executor can sell the house in due course without waiting for the beneficiaries to become the registered owners. But the sale cannot conclude until a grant is taken out to your grandmothers estate. How long it will take to get the grant will depend on whether there are substantial assets or complicated tax matters. If it is straightforward, it is possible to have a grant extracted in about 8 weeks.

Hi Zegar. This is not straightforward- if no one disputes the matter, the transfer of the money into the friends account, if the friend concurs, may be treated as a gift to that friend. However the friend may say the aunt only put it there so that she could deal witht the administration of the account for her. Or someone else, one of the aunts relatives, may dispute that it is a gift and give reasons why. In the absence of a claim or contest, the friend will be the donee. I am assuming the account is in the sole name of the friend and not in their joint names.
