query re fence

THere is a small fence you could step over between my house and neighbours. People regularly do when delivering junk mail which i do not want. i am thinking getting a picket fence. Can I put it my side of the existing fence or will i have to replace it. I want to have my own fence and paint it as i wish rather than having a shared fence
