PRTB- question on registering a tenancy

Hi
I am renting out my home to my niece and her friend.
I am not charging my niece and her friend is going to pay me E500 per month(2 bed terraced property).
When I register it with the PRTB do I need to put my niece down(as she's not paying rent Im confused).

Just register both names and total rent, how the rent is apportioned isnt required.

I do not feel I am hijacking this thread as the question is already answered. I bought a property almost 2 years ago. There was a Tenant in place whom I was quite satisfied with. I was not able to verify at the time whether the Tenancy was registered or not so I registered the Tenancy in order to be be compliant with PRTB etc.
Previous owner (on very good terms with him) has contacted me today and he informed me that the PRTB had contacted him that the 4 year term was up and that he should renew the registration etc. The previous owner wrote back to the PRTB informing them that he was not the owner since (date given) and he gave them my name & address. I have no problem with that.
For his trouble this is the reply that he received from the PRTB and I quote.

"Dear Mr .......
I wish to acknowledge receipt of your correspondence and the contents therein.

In order to update the Tenancy record 2 things are required,
1). A letter from the new owners solicitor confirming the change of ownership. This letter should be signed and on headed notepaper or a legal document that also confirms the change in ownership eg Deeds, contract, land registration.
2). Can you confirm that the landlord currently named on the Tenancy record is no longer the landlord of the property?

Please do not hesitate to contact us if you have any further queries.

Yours sincerely,
PRTB"

The above is quoted accurately. See Point 2) in PRTB letter in the reply to previous owners reply to them where he said he was not the owner. I have no intention what so ever in comply with point No 1 of their letter.

Is this Quango for real and Kelly is now going to have them administering the security Deposits. Imagine all the queries this outfit will dream up doing this.

I just could not believe what I was reading when I read the PRTB reply to the previous owner. This sort of thing should be sorted.

Deposits

As nobody seems interested I didn't even discuss Kelly's mad schemes on here. It's totally crackers to imagine the PRTB will manage deposits in an efficient manner. I will bet you 5 Euro that once this scheme is up and running we will have endless mirth (though it won't be funny) with tenants complaining on Joe Duffy about leaving a place but having no deposit for the next place becuase that is the only way this scheme will work, I can just imagine the mess the PRTB will make of it.

I re registered a 4 year tenants last month and their website is still unbelievable it's so complicated and so duplicated.

The good news for landlords though is the new rule about the District court for overholding tenants, I'm well please with that.

And of course rents are now going even more throught the roof than before thanks to Kelly.

And I also guarantee this, the deposit retention will be a boon to landlords. Because people like me who just give deposits back will now say screw that, I want money for painting etc. Stuff I'm entitled to now but don't bother with.

A relative is living in my investment property. I phoned PRTB, enquiring if I needed to register the tenancy. The reply was, that they cannot give advice I should read their website myself and then decide.

The RTA 2004 Section 3 -
(2) Subject to section 4(2), this Act does not apply to any of the following dwellings—
(h) a dwelling within which the spouse, parent or child of the landlord resides and no lease or tenancy agreement in writing has been entered into by any person resident in the dwelling,

Therefore, all other relatives, if they have a tenancy, their tenancy must be registered.

The RTA 2004 defines "tenancy" as:
‘‘tenancy’’ includes a periodic tenancy and a tenancy for a fixed term, whether oral or in writing or implied, and, where the context so admits, includes a sub-tenancy and a tenancy or sub-tenancy that has been terminated.

However, you might be able to have a Licensee Agreement with them in which case, there is no registration required with the PRTB. letting As an aside, it is often found that doing a good turn for a relative turns a relationship very sour and many people in business do not like to employ relatives other than immediate family.
