Hi

I began a tenancy with a tenant in June 08 and registered it with the PRTB.

Unfortunately I have been unaware of what is called a Part 4 tenancy. I never re - registered after 4 years.

I don't believe i ever got a notice that I should at the time from the PRTB in 2012.

So I believe I am well over a year late.

I tried submitting an application on the PRTB website but the fee payable kept appearing as "Unknown". So I am going to sent a paper form.

Could someone tell me if this will just be a matter of paying what they call the late fee or is this more serious?

Your fee will be €90 plus €90 for late payment. In total €180. That should be the end of it. You could be waiting 3 months or more for a receipt if you do it manually. The PRTB can do their thing at a leisurely pace.

I didn't get one either for a property rented around the same time by the time I realised I was already into penalty territory,sharp practice or incompetence?
 
Sorry to say, but:
As a landlord of a residential property, you are considered as in a business. As such, you should know ALL the laws pertaining to that business - RTA 2004, Housing Standards for rented accommodation, Tax laws and PRTB requirements to mention a few. Ignorance of the law is no excuse.

Being a landlord is NOT the easy option that many people (especially tenants) believe it is. As a landlord you are renting out a property valued in most cases well over 100,000 euros.

If you called a plumber and he didn't know his job, you would be upset. If you went to the dentist who didn't know his job, you would be upset. If you went to a solicitor who gave you incorrect advice, you would be very upset.

If then, as a person in business you do not know the laws pertaining to that business should you not be penalized?
 

Can you go back into the PRTB website and put the start date in 2006 and the end date 4 years later, see if that works. If it does see then if you can do an extension. Don't try and put in any more than 4 years initially. You have to think like the computer.

You seem to be worried about PRTB, instead it's revenue you need to be worried about.
