Problem with tenant

Hi, I have a tenant who left the property at beginning of April, however lease date doesn't finish till beginning of May. I have had no option but to use their deposit as their final months rent payment. I have asked for the keys back to enable a surveyor to look at the property and have been told 'no' by the tenant as they say the lease isn't over till next week even though they know I have no keys to the property.
I just wondered if it was legal for me to enter the property and change the locks in order for the surveyor to enter on his appointed date? I am also worried in case they have done any damage to the property as they have left all the curtains closed, so I can't even see in to check!
 
I would wonder why you didn't have keys to your own property?
If you had keys yourself you would have been able to give them notice of the surveyor calling.
Next time you rent the place out make sure you retain a set of keys.
 
If the tenant is now paid up until end of May with the deposit then you will have to wait as you don't want to go down the route of the tenant taking a case to the PRTB because you illegally changed the locks. It is possible the tenant is storing stuff there until lease it up. Tenant seems to be aware of their rights, it is unreasonable of them to deny you access but there is nothing you can do about it. And you should always have a spare set of keys to your property and should inspect it regularly, with tenant's permission.

Be glad they are gone easily. You may be in luck and there is no damage.

What do you mean by suveryor, do you mean engineer?
 
A deposit is not payment for last month rent a deposit is a down payment for any outstanding expenses that they cause while in the building I never let a tenant use a deposit for last month of rent they get this back if they leave no bills unpaid or nothing has to be replaced. So in my opinion the tenant has not paid you for this month I would enter the building it is up to you if you want to do it. I have been a landlord for 30 years and have never got into trouble with my dealings with a tenant as I treat them well and hope that they do the same if they chose not to do so then I am ready to do what I think is right.
