Problem with collecting rent

Hi,

I am current working abroad. The tenants in the house in Ireland has been pretty good for the most of the 2 years, I have had them. Since about 6 months ago, one month has not been paid. Then the last I checked, they have not paid on time for another month. So in total 2 months worth of rent has been unaccounted for.

I have spoken to them over the phone the inrelation to the first incident and they seemed to be shocked that the 1st payments has not gone through, but they assured me that they will sort it out. Given their past track record I gave them the benefit of the doubt. However missing rent once again has me worried. This is the last month of their annual lease.

Can someone please give me advice on what I could do from a legal standpoint and experience in dealing with the tenant, about due rent. I know there is little I could do, if they decide to leave without paying the due rent. I have previously been burnt with tenants not paying the last months rent to get the deposit back, but not when more then a months rent has not been paid.

Do you have an agent working on your behalf to collect the rent etc.?
Are you registered with the PRTB who might be able to assist if there is any dispute?
 
Is there someone living locally you can get to deal with tenants, if they know you are abroad they will take advantage. Its much harder to fob off someone who calls to the door - which you are entitled to do. Do you have a signed lease?
 
My brother lives in UK but owns apartments here. I look after them on his behalf (without payment). All rents are lodged to his account but if there is a problem, I can knock on the door.

I know this doesn't solve your problem, but keep it mind next time out.

Meanwhile, assuming that the tenants are genuinely messing you about, I'd chuck them out nowbefore the problem gets worst. They have you where they want you (i.e. away!) so cut your loses and evict them. All Lease Agreememnts clearly state that the penalty for non-paymet is eviction.

Apart from the deposit - What do landlords have against tenants, if they are being reckless?

I do have relatives who can call down to the house. But I am thinking of handing over to an agent, despite the fee. I have been trying to contact the tenant but no answer so far. So my next move is probably a letter, before I send someone down.
 
Get some you trust to talk to your tenant face to face without delay inside the property, then you can gauge what is happening.

Agent will waste your money, PRTB will take time to react.
www.threshold.ie are fairly quick at responding though and they are free.
 
The only way to resolve this issue is to have someone call to the property. Face to face one on one.

16 years ago when I first got involved in property I had to call to a late payer on a Friday evening. The tenant just stood there and never spoke. I got embarrased and walked away. The following Friday I called and the tenant told me he was not going to pay. The following Monday the bank Manager rang and asked me for the money. I explained the situation and he stated in no uncertain terms that If I did not get the money There would be 2 homeless people - me and the tenant.

I collect the rent - all of it - the following Saturday.

OP - I'd be far more worried about your non registration with the PRTB, do you realise that if your tenants leave you cannot register them and that without registration mortgage interest is not allowable against rental income. If you don't have a mortgage then of course it may not affect you nor of course does it affect you if you are not declaring your rental income but that is not to say that it may not affect you in the future.
