Potential purchaser introduced by two agents

We are selling our house. Prior to utimately deciding to sell we called Agency X who had just sold a very similar property to find out the sale price. He told us the sale price and said he had a potential buyer who was outbid.

We sent pictures and said this buyer could buy our place with a suggested price. He declined and agency X said he had purchased something else instead. No contract was ever signed with the agent and name of the buyer was never exchanged. Case closed.

We then decided to sell it and informed Agency X that we were going approach other agencies for fees. We selected an alternative Agency Y (lower fees) and advertised the property.

It now seems the buyer identified by the Agency X is now interested in our property (we believe so as their long back story is the same). Their purchase isnt progressing and is considering dropping out of that (losing the Agency X this fee).

If we did sell to this person, would fees be due to one or both agencies?

If you didn't sign a contract with the first agent, it's hard to see how they could claim a fee. They may be happy just to pass a client on to someone else or they may not realise that you have entered into a contract with another agency.

Agency Y's fee will almost certainly be payable even if they are not the ones who introduce the buyer, that'll be covered in the contract you signed with them.

Best inform agency X that agency Y have exclusive representation rights for the property, and if they wish, they can pass on the details of the interested party. They may look for an additional finders fee, it's up to you then whether it's worth paying that.

Agency X had the client on file as they had previously been interested in a property with them. They contacted the client regarding our property when we were only starting to consider selling.

That depends if they signed a sole agency agreement or not.
