Hi we are signing the contracts with our solicitor today, for a house we are purchasing.

Something has come to mind though. The seller has built another house on the site of the house I am buying and is moving into it.

It is at the end of the back garden. There is a fence at the end of the garden, and the new house is behind it.

He got planning permission so that is ok.

But my problem is, because it was built on the land of the house I am buying, Could he turn around in a couple of years and move the fence back, saying that the land is part of his house and he had planning permission for more of my back garden.

Also could this affect me applying for planning permission in the future lets say to built an extension, that the planning attority could come back and say that the site is over developed.

surely the contract will detail the exact layout of your property and the boundry with the other property. a simple question for your solicitor to handle.

In terms of what you are buying, your solicitor should be able to confirm exactly what you are buying and what the measurements are. If you have bought the garden, he cannot move his fence into it. If you haven't he can as you don't own it

Planning permission could be an issue going forward, depending on what you are building but it's difficult to comment on any over developement type issues without kmowing the nature of the site.

When you go to sign today the solicitor should have a map of the land showing which is your piece of land and showing the boundaries, so ask him/her any questions there and if you need to wait till these questions are answered to your satisfaction then do that before signing.

You should always get a structural survey done for a second hand house and check the boundaries to the property prior to signing contracts.

Do not sign until you are sure where the boundaries are. Boundary disputes can drag on for years. Seriously.

Get a copy of the map and walk the site, get an engineer to look at it, take photos showing the location of the fence. Make sure you are clear EXACTLY what you are buying.


As for the planning, no idea.
 

Planning permission goes with the land so if he transfers to you land which he had planning permission for you will get the benefit of it.

You can build extensions to the back of your house within a certain size which would be exempt from planning.
