A relative of mine had an accident in Spain involving a bus over three years ago. She was hospitalised at the time of the accident, which the bus company fully paid for and any other medical costs.
When she returned home she got a solicitor to claim from the bus company for personal injuries.
After three years she has basically heard nothing of her claim until recently when her Irish solicitor said that a Spanish company has taken her claim and they required €5000 up front for fees.
The problem is this, A/ Her Irish solicitor gave her case no hope all along as it was in Spain and he felt that the bus company had given her all the compensation she deserved(she had been in hospital for four days and had a dislocated shoulder)as they paid for her medical bills.
B/ She feels uncomfortable handing out the 5 grand because her Irish solicitor said the case was no good and if hes right then the money would be wasted
She has come to conclusion, rightly or wrongly that her Irish solicitor hasn't been very good handling this case and she understood that she would only have to pay the costs after she lost the case.
Is this how Spanish law works?
Also, is it now possible to get another Irish solicitor to handle the case?
