Paul Kenny, Pensions Ombudsman, former long time member of the pensions industry and long time critic of PEPS ( Pension Enlightenment for Public Servants ) referred PEPS for investigation to the Financial Regulator prior to the Prime Time Program of 13/11/2008.

The regulator did not act on the Ombudsmans report and last Friday informed PEPS that they had no intention and never had any intention of pursuing us. In their memo they mentioned that any Irish citizen who does NOT PROFIT from the sale of AVC's is free to helpfully advise colleagues on pensions. PEPS do not advise; they do pension Optimization lectures and take questions.

The Ombudsman's complaint to the regulator was based on data supplied by Mr. X who profits significantly from the two major AVC providers. PEPS revelations have already severely dented his income.

Days before the Prime Time program Mr. X threatened PEPS with legal action citing a quotation from the ombudsman. PEPS twice asked the ombudsman to clarify. He refused to give any information to PEPS but had no problem however in informing the Sunday Times (See Sunday Times article 16/11/2008).

PEPS believe in truth, transparency and accountability for all . The regulator cannot release Mr. X's file for PEPs to answer to without the Ombudsmans permission. So far he hasn't agreed to our request.

We appeal to the ombudsman to respond. PEPS, who represent consumer interests feel that they are entitled to the same protection and fair play as the big guns in the pensons industry.
