Payroll error and Redundancy

Folks,

A quick question for those in the know. I've taken voluntary redundancy and HR have contacted me to inform me that there was a payroll error and I've actually been overpaid during the last few months, and they're looking to recover the funds from my redundancy lump sum.

I was quite shocked as they initially suggested they would suspend my last salary, and I have a mortgage and bills to pay!

Legally, what is my position here? This is a human error on the payroll side. I was going to suggest that they recover this from the lump sum that they're going to pay to me in the end, but am I legally obliged to refund them?

And second question, I've paid a health levy and income levy on the additional sum they've been paying me in error, but I've been told that I can apply for the refund of the levy paid on the redundancy lump sum. If I let them take the money off my lump sum, then I won't be able to get a refund on that amount. Is that correct?

Thanks a mil in advance!
