Looking for some advise opinions!! I went to view the estate I bought into in Wicklow my house due to be completed in about 2 months and noticed that very few houses were being built with gaps between the ones actually being built and I queried the builder. Found out that they are building only the ones that were sold after pushing the foreman.. Originally told estate was sold out by auctioneer??

Now I have a house with no neighbours!! The builder is saying he will finish off the estate footpaths, green area etc but only 7 out of 17 houses will be built with I presume empty sites. (which could be unsold for months or the builder could go bust).

Has anyone gone through this? I now want to get out of the contract but not sure if I have a leg to stand on? Living on a building site for years was not what I signed up for. Any comments would be much appreciated.

You were told the estate was sold out. Your purchase was influenced by that. It could be worth asking your solicitor if that would be grounds for not proceeding with the purchase.

Thanks I read the article in the sunday business post that case went all the way to the high court to settle a €1.5m dispute. Contacted my solicitor last friday so I will see what the experts say.

A lot of contracts used to contain a clause excluding any representations made before contracts signed so check that too.

It doesn't matter what the estate agent told you as that's not in the contract, as for the builder 'saying' he will finish off the estate, you need that in writing and even then if the builder goes bust where will you be. You need to ask your solicitor about this. Also I think you'll find the contract is watertight and you won't be able to get out of it.
