Parental Leave and Holiday Pay

I have been taking parental leave since last September. By agreement with my employer, I am taking 1.5 hours per day. I am contracted to work a 39 hour week and from it I take a total of 7.5 hours leave per week. I know that I am not entitled to be paid for this time :(. To calculate my pay, my employer has essentially adjusted my salary by a factor of (39-7.5)/39. This seems the correct way for a normal 5 day week, but when I take annual leave, or there is a public holiday, am I not entitled to be paid my full salary and not the adjusted amount? With the way he has calculated it, my salary on those days is docked for the hour and a half too.

There is no issue with my entitlement to 14 weeks or the equivalent in hours, I will be able to take extra hours at the end of the period, equivalent to the number of public holidays and annual leave days since I started taking the parental leave.

Has anyone come across this situation before or can you point me to some advice? The usual websites don't seem to cover it. Thanks for your help as always.
 
from my understanding of parental leave you are entitled to your full salary when taking holidays or a public holiday. might just be an oversight on your employers half
 
I am also taking my Parental Leave in terms of hours per week - I take 15 hours per week. My employer basically pays me a flat 61.5% of my normal full-time salary as I only work 61.5% of my normal full-time hours. When a public holiday or a vacation day falls on a day when I would normally take parental leave it does not make any difference to my pay that month - it is still just 61.5% of normal. Technically when I am off due to a public holiday/vacation I should be paid for that day in full but I think that is too messy for my employer to recalculate my salary each month and it is too messy for me to keep track that the calculation has been done correctly so I am happy to paid just 61.5% of my salary even though I may be entitled to slightly more given the public holiday/vacation. I keep a note of these days though and when the 14 permitted weeks parental leave has been deducted from my salary I should technically be back at work full-time but I will take the extra hours worked as leave the end but on full salary so it all works out...am I helping?
 
Timmore, your employer would seem to be following the same method as mine. But as both you and Ioll agree, the employer should be paying the full rate for the leave/ public holiday days.

I reckon that about 15 days are affected so far, so that's 22.5 hours or over half a week's wages, and I haven't used my full entitlement yet. I don't think it should be that difficult for employers to work this out, there are much more complex issues around pay that the software seems to be able to manage.
 
Agreed - if your preference is to be paid than your employer should ensure this happens - you are right that is not difficult to work out. Personally, I just find it easier not to bother and stick with the flat rate but then it is also my strong preference to stretch out my parental leave as long as possible so it suits me to add time on at the end.
 
Public holidays are easy to work out, you are entitled to one fifth of your weekly wage if you don't work for the day. Therefore if your employer has reduced your wages because you have reduced your hours, therefore it is correct that your pay for public holidays is reduced. See attached for further details

"Taking parental leave does not affect other employment rights you have. Apart from the loss of wages, your position remains as if no parental leave had been taken. This means, for example, that time spent on parental leave can be used to accumulate your annual leave entitlement."

Therefore the employer should pay at your normal rate and not at the reduced rate.
