Advice please
Could a separated father, who is living (separately) under the same roof as his spouse (i.e. the spouse from whom he is separated - they are sharing the marital home for financial reasons and for the sake of the children)) qualify for a One parent Family tax Credit? Revenue leaflet states that "A One-Parent Family Tax Credit ... can be claimed if you are a single parent (whether widowed, single, deserted, separated or divorced) and you have a child who is dependent on you" It further states that " You do not qualify for One-Parent Family Tax Credit if:
  • You are a person qualifying for the Married Person's Tax Credit or
  • You are a person living together with another person as man and wife"
The point at issue in this case is that although the individual is sharing a house with another person (his former wife) they are not living together as man and wife.

I am in a similar situation, but the main difference in my case is that I am not married to my partner and we have 2 children. We have separated in the past year and whilst sharing the same house for financial & children reasons, we are not living together as man and wife. However we cannot financially afford to live separately.

So my question is: can I qualify for a One Parent Family tax Credit "as a partner living separately under the same roof as my former partner but not as man and wife"?

A friend of mine was awarded the One Parent tax credit some years ago and was in a similar situation to "Datacopy".
She is at present in the process of a legal separation and expects to move into alternate accommodation shortly
 
How do they prove that you are ' not living together as man and wife '' ? if you are living under the one roof .
