What will happen if a person gets grant of probate by omiting another person and then they get paid out through this and the other party gets nothing.

The question doesn't make any sense. You can't omit a person by getting probate - it doesn't work like that.

Can you give some more details if you want to get a better reply - was there a will ? who was executor ? what exactly is the problem ?
